Writing an offer

Say "write an offer for Maria" in the chat or on a call. Beverly asks what the Texas contract needs, runs the Contract Analyzer's checks, fills the TREC forms and sends them for signature on your yes.

Live, with limitsWorking today, with the limits named on this page. Texas only, on the TREC 20-19 resale contract with the financing, HOA, non-realty items, lead-based paint and lease addenda, for up to two buyers and two sellers. Sending for signature works once SignWell is connected for your account; until then Beverly hands you the filled PDF to send yourself. Opening the deal file from a signed offer is part of the Transaction Assistant, which is in testing.

An offer is the form most newer agents dread, and it is mostly typing what the buyer already told you. Beverly takes it as a conversation instead: the same questions in the same order an experienced Texas agent fills them, every answer landing in the real contract.

  1. Start it. In the chat or on a call: "let's write an offer on 123 Main", "draft an offer for Maria", or the same in Spanish or Vietnamese. When the buyer is one of your leads, Beverly starts with the name, email and property on that lead's record, and with your team's offer defaults: the title company, the option fee and days, the earnest money and a closing date 30 days out.
  2. Answer the questions. One or two at a time, in the contract's own order: the parties, the price and how they are paying, the loan, what the seller keeps and any leases, the earnest money and title company, the option, closing, the survey and disclosures, who pays a new survey if the old one fails and the shortages exception, the seller's water disclosure, whether the home is in a water district, a certificated area, on septic or on a lake, the money at closing, the HOA and what stays with the house, who pays the HOA fees, the year built, special provisions, and the listing agent. The rare ones come with the usual answer said first, so "yes" is an answer. Say several at once and Beverly takes them all: "425 conventional, 20 down, 5k earnest, 500 option for 7 days, close November 20" answers five questions. Every answer is said back in one line.
  3. The check. Before anything is built, Beverly runs the Contract Analyzer's checks on the offer and reads out what to fix, like a financing approval period that runs past closing, an option fee with no option period, or a lease box with no lease addendum. You fix it in a sentence, or build it as it is. This is the one charge: the Contract Analyzer's price, once per offer. Every fix, revision and re-send of that offer after it is free.
  4. The PDF. Beverly fills the TREC forms and shows the offer as a card: the price, earnest money, option, closing, financing and addenda, with the PDF to open. The PDF is fillable: every blank and every check box is a real form field, carrying what Beverly filled and empty where you left it, so you can change anything in Preview, Acrobat or your phone without printing it. What goes out for signature is a fixed copy of what you saw.
  5. Signatures. Beverly asks before anything goes out, with the emails it is going to: "Send to Maria for signature?" Only a plain yes sends it. Your buyers sign in SignWell, you are copied, and you get a push the moment they sign, with the next step: send it to the listing agent.
  6. Send it to the listing agent. Say "send this offer to the listing agent's email" with the address, or just "send it to the listing agent" and Beverly asks for the email (on a team with the MLS feed, Beverly names the listing agent from the listing and still asks for the email, never guessing one). You see one card first: who it goes to, the subject, and every file attached, with Send it and Not yet. On your yes the signed offer and anything you attached go out as an email from your own address, with your signature, and you are copied. If you would rather the sellers sign through SignWell, say "through SignWell" and Beverly sends it to the listing agent for the sellers' signatures instead.
  7. Attach the pre-approval. Drop the lender's letter or the proof of funds into the chat with a word about it, like "this is the pre-approval for the Dufour offer", and Beverly puts it on that offer: it shows on the offer's card and record, and it rides along in the email to the listing agent.
  8. Counters and changes. Say what changed, like "they countered at 445, closing Dec 7" or "change the option fee to 400". Beverly makes a new version of the same offer, keeps the earlier one on the record, cancels the signature request the buyers had, runs the checks again, rebuilds the PDF and asks before sending the revised offer for signature. None of that uses another report. Once both sides have signed, a change is an amendment, and Beverly says so.
What Beverly does not fill yetSeller financing, a loan assumption, a temporary lease, a condominium (TREC 30-18) and new construction each need a form Beverly does not fill yet. Beverly says so by name and you attach that form yourself. The lead-based paint addendum for a home built before 1978 is asked about and attached; its seller half and the buyer's acknowledgment boxes are fields on the PDF for the parties to complete.
Your offer defaultsSettings, Leads, Offer defaults holds the terms Beverly fills in every time: the option fee and days, the earnest money as a percent of the price, the days to closing, the days to object to title, and your broker's details for the broker page. The title company is the one you starred on the Vendors page. You can also say it: "set our default option fee to 500 and option days to 7". Beverly says each default it used, every time, so nothing is filled in silently.
On a call, and in the appOn a call the turns are short and the side notes wait for the screen. In the app the offer shows as a card in the conversation, with Open the PDF under it (the signed copy once the buyers sign), and a pre-approval attached in the app's chat goes onto the offer the same way. Send for signature and Not yet are buttons under the question. When the buyers sign, the notification opens the chat with the next step already typed, waiting for you to send it.
