These Terms of Service (the “Terms”) are an agreement between you and Get Beverly (“Beverly,” “we,” “us”). By creating an account, subscribing, or using the service, you agree to these Terms. If you do not agree, do not use the service. If you use Beverly on behalf of a company or team, you confirm you are authorized to accept these Terms for that organization.
Beverly is an AI assistant and software tool built to help real-estate professionals with everyday work: drafting messages, organizing leads, preparing comparative market analyses (CMAs) and net sheets, reviewing offers, and coaching. Beverly is a software product only.
Beverly is not a real-estate broker, attorney, lender, appraiser, tax advisor, or financial advisor, and does not provide professional advice. Nothing Beverly produces is a substitute for the judgment of a licensed professional. You remain the licensed professional in every transaction, and all professional decisions are yours.
Beverly is intended for licensed real-estate professionals and their teams. You must be at least 18 years old and provide accurate account information.
You are responsible for everything that happens under your account, for keeping your login credentials secure, and for the activity of anyone you allow to use it. Tell us promptly if you believe your account has been used without your permission.
Beverly offers a free tier so you can try it. Beverly Pro is $25 per month, or $250 per year, plus credits for certain usage. Paid plans are month-to-month (or annual, if you choose), billed in advance through our payment processor, and you can cancel anytime. When you cancel, you keep access through the end of the period you already paid for.
Prices may change over time; if they do, we will give you notice before a change affects you, and the new price applies to your next renewal. Taxes may apply depending on where you are.
Use Beverly lawfully and in good faith. You agree not to:
We may suspend or limit accounts that put the service, our other customers, or third parties at risk.
Beverly drafts messages, reviews, CMAs, net sheets, and offers to help you move faster. You review and approve everything before it is sent or relied upon, and you are responsible for what you send. Beverly is a drafting assistant, not the sender of record.
You are responsible for complying with every law that governs your outreach to your contacts. That includes, without limitation, the CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA), Do Not Call (DNC) rules, and fair-housing laws. You are responsible for having the consent and the lawful basis to contact the people you contact, and for honoring their opt-outs.
You are responsible for the accuracy and lawfulness of the data you upload or connect, and for having the right to use it with Beverly.
Beverly uses artificial intelligence, and AI-generated content can be inaccurate, incomplete, or out of date. Any numbers Beverly produces — property values, net sheets, estimates, or projections — are estimates only. They are not guarantees, and they are not professional appraisals, lender quotes, or accounting figures.
Nothing Beverly produces is legal, financial, lending, tax, or real-estate advice. Before you rely on anything Beverly gives you, confirm it with your broker, attorney, lender, or the appropriate licensed professional.
The service is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, secure, or that any output will be accurate or meet your needs.
To the fullest extent the law allows, Beverly will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, lost deals, lost revenue, lost data, or loss of goodwill, even if we were advised such damages were possible.
Beverly's total liability for all claims relating to the service will not exceed the greater of (a) the amount you paid us for the service in the 12 months before the claim arose, or (b) $100. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
You agree to defend, indemnify, and hold Beverly and its people harmless from claims, damages, losses, and costs (including reasonable legal fees) that arise out of your use of the service, your content and data, your outreach to your contacts, or your violation of these Terms or of the law.
Beverly works alongside third-party services — for example our payment processor (Stripe), messaging and telephony providers (such as Twilio), email delivery providers, and multiple listing service (MLS) and other data sources. Those services are operated by others under their own terms, and we are not responsible for their acts, omissions, availability, or content. Your use of them may be subject to their agreements.
Beverly, including its software, design, and brand, belongs to us and our licensors. We grant you a limited, non-exclusive, non-transferable right to use the service while your account is in good standing, for your own real-estate business.
You keep ownership of the content and data you bring to Beverly. You grant us the rights we need to operate and improve the service and to deliver output to you. As between you and us, the drafts and output Beverly generates for you are yours to use in your business, and you are responsible for reviewing them before use.
We may update the service and these Terms from time to time. If we make a material change, we will take reasonable steps to let you know, and the updated Terms apply going forward. Continuing to use the service after a change means you accept it.
You can stop using the service and cancel anytime. We may suspend or end your access if you violate these Terms, if required by law, or to protect the service and its users. Sections that by their nature should survive — such as payment owed, disclaimers, limitation of liability, and indemnification — survive termination.
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules.
We would rather solve any problem directly, so please contact us first. If we cannot resolve a dispute informally, you and Beverly agree that it will be settled by binding arbitration on an individual basis, and not in a class action. The arbitration will be administered by [arbitration body — counsel to set] under its rules then in effect, and will take place in [county / city, Texas — counsel to set], which is also the exclusive venue for any matter that a court must hear. To the extent the law allows, you and Beverly waive any right to a jury trial and to participate in a class action.
